ArtistStamp is a platform that enables users to:

• Create, mint, and manage Non-Fungible Tokens (NFTs) on the Polygon blockchain
• Upload and showcase digital artwork and NFT collections
• Access AI-powered tools for metadata generation and market insights
• Track analytics and performance metrics for their NFTs
• Engage with a community of digital artists and collectors

Our Service is provided "as is" and we make no warranties about the availability, functionality, or performance of the Service.

Account Creation

To use certain features of our Service, you must connect a compatible cryptocurrency wallet. You are responsible for maintaining the security of your wallet and private keys.

User Conduct

You agree not to:

• Upload content that infringes on intellectual property rights
• Create or distribute malicious content, spam, or scams
• Manipulate or attempt to exploit our pricing or ranking systems
• Use our Service for illegal activities or money laundering
• Attempt to hack, disrupt, or gain unauthorized access to our systems
• Impersonate others or create fake accounts

Your Content

You retain all rights to content you upload to ArtistStamp. By uploading content, you grant us a non-exclusive license to display, store, and distribute your content as necessary to provide our Service.

Intellectual Property Rights

You represent and warrant that you own or have the necessary rights to all content you upload. You are solely responsible for ensuring your content does not infringe on third-party rights.

DMCA Policy

We respond to valid DMCA takedown notices. If you believe your intellectual property has been infringed, please contact us at legal@artiststamp.com with detailed information about the alleged infringement.

NFT Ownership

When you mint an NFT through our platform, you receive ownership rights as recorded on the Polygon blockchain. However, owning an NFT does not grant you copyright or other intellectual property rights to the underlying content unless explicitly stated.

Blockchain Risks

Blockchain transactions are irreversible. You acknowledge the risks associated with cryptocurrency and blockchain technology, including but not limited to:

• Price volatility of cryptocurrencies and NFTs
• Potential loss of private keys or wallet access
• Network congestion and failed transactions
• Smart contract vulnerabilities or bugs
• Regulatory changes affecting NFTs or cryptocurrencies

Platform Fees

ArtistStamp charges a 2.5% fee on secondary sales of NFTs minted through our platform. This fee is automatically deducted when a sale occurs.

Subscription Fees

Subscription fees are charged monthly and are non-refundable except as required by law. You may cancel your subscription at any time, with cancellation taking effect at the end of your current billing period.

Gas Fees

You are responsible for all blockchain gas fees associated with minting, transferring, or trading NFTs. These fees are paid directly to the blockchain network, not to ArtistStamp.

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information when you use our Service.

We may collect analytics data to improve our Service, including wallet addresses, transaction history, and usage patterns. This data may be anonymized and aggregated for research purposes.

You have the right to request deletion of your personal data, subject to our legal obligations and the immutable nature of blockchain records.

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARTISTSTAMP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION.

Market Risks

We are not responsible for market fluctuations, failed transactions, or losses related to cryptocurrency or NFT trading. Users participate in digital asset markets at their own risk.

We may suspend or terminate your access to our Service at any time for violations of these Terms or for any other reason at our sole discretion.

You may discontinue use of our Service at any time. Upon termination, your right to use the Service ceases immediately.

NFTs minted through our platform will remain on the blockchain and accessible through other platforms, as blockchain records are immutable and decentralized.

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

You waive any right to a jury trial or to participate in a class action lawsuit against ArtistStamp.
